Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of GuessOurDay.com, our mobile applications, and related services (together, the "Service"), which are operated by Lanai Group LLC ("Guess Our Day," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the permission and supervision of a parent or legal guardian. By using the Service, you confirm that you meet these requirements.

3. Accounts, Guest Entries, and PINs

Some features require an account. You agree to provide accurate information, keep it up to date, and keep your credentials confidential. You are responsible for all activity under your account.

Guests may participate in events without an account and may protect their entry with a PIN. PINs cannot be viewed, recovered, or reset by Guess Our Day or by event hosts. If you forget your PIN, you permanently lose the ability to edit or view that entry. You can avoid this by linking your entry to an account, which replaces the PIN with your login. You are responsible for keeping your PIN confidential.

4. The Service

Guess Our Day provides tools for creating and participating in entertainment games at weddings and similar events, including prediction questions, scoring, leaderboards, guestbooks, event timelines, and a directory of wedding vendors. Features available for an event depend on whether the event is free or paid.

Event hosts control how their event is set up, who can manage it, and when results are finalized. Once the first guest submits guesses, an event's questions and game settings are locked to keep the game fair. Guesses close at the event's scheduled end time. Hosts are responsible for grading their events accurately, and every question must be graded before results are finalized.

5. Entertainment Only; No Gambling

The Service is provided for entertainment and bragging rights only. Guess Our Day does not operate, facilitate, or process gambling, wagers, or prize payments of any kind, and the Service does not transfer money between users.

Any prize, reward, or incentive offered in connection with an event is offered solely by the event's creator. Offering a prize may be considered gambling in some places, and event creators are solely responsible for complying with all applicable laws relating to contests, games, and promotions. Guess Our Day does not encourage or endorse prizes and is not responsible for any prize or for disputes between users relating to prizes or results.

6. Donation Links

Event creators may display links or details for third-party payment services such as Venmo, Cash App, or Zelle so that guests may give gifts directly to the couple. Guess Our Day does not process, receive, hold, or take any portion of these gifts and is not responsible for transactions made through third-party services. Details entered for these services, including any email address or phone number used for Zelle, are visible to anyone with access to the event.

7. Acceptable Use

You agree to use the Service only for lawful purposes. You agree not to harass, threaten, or abuse others; post unlawful, infringing, or harmful content; attempt to access accounts, entries, or data that are not yours, including by guessing PINs; interfere with the Service or its security; manipulate event results, ratings, or reviews; post fake or misleading reviews; or use bots, scrapers, or other automated means to access the Service without our permission.

8. Your Content

The Service lets you submit content such as event details, questions, guesses, names, profile pictures, guestbook messages, photos, videos, vendor listings, reviews, and responses ("Your Content"). You keep ownership of Your Content. You grant Guess Our Day a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, and distribute Your Content as needed to operate, provide, and improve the Service, including creating downloadable copies of events for their management teams.

You are responsible for Your Content and confirm that you have the rights needed to share it, including the consent of people who appear in photos or videos you submit.

9. Moderation

Guess Our Day does not review content before it appears and does not actively monitor events. Content within an event is generally visible only to people with access to that event. We may, at our discretion, remove, edit, or restrict content or accounts that we believe violate these Terms, are unlawful, or create risk for the Service or its users. This includes changing offensive names and removing reported reviews or responses. Event hosts may remove guest profile pictures within their events.

10. Vendor Directory and Reviews

Vendors are solely responsible for the accuracy of their listings and for the services they provide. Guess Our Day does not endorse, verify, or guarantee any vendor, and any arrangement between you and a vendor is solely between you and that vendor.

Reviews must reflect genuine experiences. Reviews are limited to one rating per IP address for each vendor per day, and we record IP addresses with reviews to prevent abuse. Vendors may post one public response to each review. Anyone may report a review or response, and we may remove reviews or responses at our discretion. Search ranking considers factors including ratings, the number of reviews, whether a listing is a paid listing, and distance.

11. Data Retention and Downloads

Event data, including guestbook photos and videos, is kept for 90 days after the event's scheduled end time and is then permanently deleted. When an event has been finalized and its guestbook period has ended, the event's management team may download a copy of the event. You are responsible for downloading anything you wish to keep before it is deleted.

12. Fair Use

Some features are described as "unlimited." Unlimited features are subject to reasonable use consistent with normal use of the Service for a single event or listing. We may limit, suspend, or restrict use that is excessive, abusive, automated, or harmful to the Service or other users.

13. Fees and Payments

Some features require payment. All purchases are governed by our Payment & Billing Policy, which forms part of these Terms.

14. Communications

By using the Service, you agree to receive service communications from us, such as account notices, invitations, event results and reminders, receipts, and support messages. Blog emails are sent only to people who subscribe and confirm their subscription, and you can unsubscribe at any time using the link in any blog email. Push notifications are sent only if you allow them on your device.

15. Suspension and Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, engage in fraud or abuse, or if required by law. You may stop using the Service and delete your account at any time.

16. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that any content will be preserved beyond the retention periods described in these Terms.

17. Limitation of Liability

To the fullest extent permitted by law, Guess Our Day and Lanai Group LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim arose.

18. Indemnification

You agree to indemnify and hold harmless Guess Our Day and Lanai Group LLC from any claims, damages, losses, and expenses, including reasonable legal fees, arising from your use of the Service, Your Content, any prize you offer, or your violation of these Terms.

19. Service Availability

We aim to keep the Service available but do not guarantee any particular level of availability. The Service may be unavailable from time to time for maintenance, updates, or reasons outside our control, and we are not responsible for any resulting impact on an event.

20. Force Majeure

We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, power or internet outages, failures of third-party service providers, labor disputes, or government actions.

21. Dispute Resolution and Arbitration

To the fullest extent permitted by law, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, and not as a class action or class arbitration. Arbitration will take place in Washoe County, Nevada, unless the parties agree to hold it remotely. You and Guess Our Day each waive the right to a jury trial and to participate in a class action. This section does not prevent either party from bringing an individual claim in small claims court or from seeking relief that cannot be waived under the laws of your country of residence.

22. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where the laws of your country of residence require otherwise. Subject to the arbitration section above, any claim that is not subject to arbitration will be brought exclusively in the state or federal courts located in Washoe County, Nevada, and you consent to the jurisdiction of those courts.

23. Changes to These Terms

We may update these Terms from time to time and will post the updated version on this page with a new "Last Updated" date. Your continued use of the Service after changes are posted means you accept the updated Terms.
